The trial judge in the case involving, DSP
Gifty Mawuenyega Tehoda in the cocaine turned into sodium bicarbonate saga
yesterday told the prosecution that the lower court was yet to see a copy of
the bail bond that was granted to the accused by the Accra High Court, ordering
her to report to the BNI periodically.
Ms. Audrey Korcuvie-Tay , the Circuit
Court trial judge presiding over the case made the statement after
prosecution told the court that, DSP Tehoda has since refused to avail herself
before the investigation team or authorities of the Bureau of National
Investigation as directed by the High Court as part of the condition in her bail bond.
Mr. Kwabenea Owusu Ameyaw, an Assistant State
Attorney, who represented the state in the case yesterday, said the accused has
since failed or refused to report the BNI since the day she was granted bail and
urged the court to take judicial notice of such action by the accused.
He also informed the court that, the substantive
prosecutor, Mr. Rexford Wiredu, was indisposed and has asked that the case be
adjourned to a date subject to the convenient of the court.
The defence counsel were also absent without
any notice to the court and the court therefore adjourned the matter to April 2,
this year.
At the last sitting the prosecution informed
the court that, two of its witnesses were ready to give evidence in the case
but was outside the jurisdiction.
According to the state prosecutor, investigation
into the matter has since been concluded and the state had got two witnesses
who are ready for the trial to begin and prayed the court to adjourn the case
till yesterday.
DSP Mawuenyega Tehoda , faces one count for abetment
of crime to wit, undertaking an activity relating to narcotic drugs following
the substitution of the charge sheet for abetment of crime and stealing of cocaine.
She was granted bail by Accra Fast Track High
Court in the sum of GHC100, 000.00 with two sureties; one to be justified after
the Circuit court denied her bail.
As
usual, a large group of sympathies including her husband and family members
followed her to court.
